MOTOR-VOTER STATE LAWS
1. Oregon. Oregon is one of the 27 states that already has a motor-voter law on the books. The Oregon statute requires DMV officials to affirmatively ask applicants whether they would like to register to vote. If so, the applicant is given a combined driver's license/voter registration application. S. 460, on the other hand, requires states to distribute combined applications, without asking applicants whether they want to register to vote. Once the application is filled out, the applicant is automatically registered to voter.
S. 460 allows states to escape from the bill's requirements if they adopt same-day registration. Financially-strapped states may opt for same-day if they consider it a cheaper approach.
In 1986, an Oregon law authorizing same-day registration was repealed. As you know, the law had been abused by a cult leader (Bhagwan Shree Rajneesh) who literally bused into his county 4,000 homeless people for purposes of participating in a county- wide election.
In other words, S. 460 is fatally flawed because of the potential for fraud caused by the same-day escape hatch.
2. Minnesota. Minnesota established a motor-voter program in 1987. Unlike S. 460, which requires states to create combined driver's license/voter registration applications, the Minnesota program has established separate forms for a driver's license and voter registration.
Minnesota has also established a public-agency system of voter registration.
Nevertheless, Minnesota is one of only three states that currently allows for same-day registration. The requirements of S. 460 will, therefore, not apply to Minnesota because of the same-day escape hatch.
3. Vermont. Vermont established a motor-voter program in 1986. Unlike S. 460, which requires states to create combined driver's license/voter registration applications, the Vermont program has established separate forms for a driver's license and voter registration. Vermont also requires an oath.
4. Pennsylvania. Pennsylvania has established systems for voter registration by mail and at public agencies. Pennsylvania, however, has not established a motor-voter program.

SALE OF ASSETS BY FARMER COOPERATIVES
MR. PRESIDENT, I AM PLEASED TO JOIN MY COLLEAGUES IN SUPPORT OF THE MUCH-NEEDED "SALE OF ASSETS" LEGISLATION. THE FARMER'S COOPERATIVES IN MY HOME STATE OF KANSAS, AS WELL AS THROUGHOUT THE NATION, ARE FACED WITH NEEDLESSLY COMPLEX AND CONFUSING TAX RULES.
THE PROBLEM IS THAT WHEN A FARM COOPERATIVE SELLS AN ASSET IT MUST DETERMINE FOR TAX PURPOSES WHETHER THE INCOME OR LOSS FROM THE SALE IS PATRONAGE SOURCED. ON INCOME CLASSIFIED AS PATRONAGE SOURCED, THE COOPERATIVE MAY BE REQUIRED TO DISTRIBUTE IT TO ITS "PATRONS" WHO PAY TAX ON THE INCOME. BUT, IF THE INCOME IS CLASSIFIED AS NON-PATRONAGE SOURCED, THE COOPERATIVE MUST PAY TAX ON SUCH INCOME WHETHER OR NOT IT IS DISTRIBUTED TO PATRONS .
THIS ISSUE IS NOT NEW TO THE SENATE. THE MAJORITY OF THE MEMBERS OF THE COMMITTEE HAVE SPONSORED THIS LEGISLATION IN THE PAST. IN FACT, A MAJORITY OF THE ENTIRE SENATE WERE COSPONSORS LAST YEAR. IT IS ALSO IMPORTANT TO NOTE THAT THIS IS A NATIONAL ISSUE. BECAUSE OF THE BROAD-BASED SUPPORT AMONG ITS MEMBERSHIP, THIS BILL REMAINS AMONG THE TOP LEGISLATIVE PRIORITIES OF THE NATIONAL COUNCIL OF FARMER COOPERATIVES.
THE LEGISLATION INTRODUCED TODAY WILL SERVE TO SIMPLIFY TAX LAWS DEALING WITH THESE COOPERATIVES. UNDER THIS BILL COOPERATIVES CAN ASSURE THAT GAIN OR LOSS FROM THESE ASSET DISPOSITIONS WILL BE TREATED AS PATRONAGE SOURCED BY DEMONSTRATING THAT THE ASSET IN QUESTION HAD, IN FACT, BEEN USED BY THE COOPERATIVE TO FACILITATE THE CONDUCT OF PATRONAGE OPERATIONS. THIS SO-CALLED "FACILITATIVE" TEST DERIVES FROM A LONGSTANDING IRS REVENUE RULING THAT APPLIES REGARDLESS OF THE CHARACTER OR TYPE OF ASSET INVOLVED, AS LONG AS THE REQUISITE FACTUAL NEXUS TO PATRONAGE OPERATIONS CAN BE DEMONSTRATED.
AS AN INTEGRAL PART OF THE AGRICULTURAL ECONOMY, IT IS ESSENTIAL FOR THESE COOPERATIVES TO BE ABLE TO TIMELY DETERMINE WHETHER INCOME IS PATRONAGE SOURCED. KANSAS, ALONE, HAS 224 FARMER COOPERATIVES OPERATING IN VIRTUALLY ALL OF THE STATE'S 105 COUNTIES. A SUBSTANTIAL NUMBER OF THE 70,000 FARMERS THROUGHOUT THE STATE ARE OWNER-MEMBERS OF THESE ORGANIZATIONS. OBVIOUSLY, THESE LOCAL COOPERATIVES AS WELL AS THE REGIONAL COOPERATIVES WHICH THEY OWN HAVE A VITAL STAKE IN THIS LEGISLATION.
IT IS MY HOPE, MR. PRESIDENT, THAT WE WILL BE ABLE TO FINALLY END THE CONFUSION AND PASS THIS LEGISLATION IN 1993. FARMERS ARE NOT ASKING FOR A TAX BREAK - JUST SIMPLIFICATION.
