PROPOSAL FOR INVESTIGATION (v.3)
1. Special Independent Counsel: jointly appointed by the two Leaders
2. F.B.I., G.A.O. (and other Federal agencies), as appropriate, to be utilized to conduct the investigation;
3. Investigation to cover unauthorized disclosures in connection with the following investigations:
A. Nomination of Clarence Thomas to be an Associate Justice to the Supreme Court, by the Committee on the Judiciary;
:selected: B. Investigation of matters related to Charles Keating by the Select Committee on Ethics; and the
:selected: C. Nomination of Timothy Ryan to be Director of the Resolution Trust Corporation, by the Committee on Banking, Housing, and Urban Affairs;
4. Special Independent Counsel to have authority to conduct depositions under oath, issue subpoenas, and seek appropriate ruling / enforcement by the {underlined: Rules} Committee for any witness who refuses to cooperate with the investigation;
5. Upon completion of the investigation, the Special Independent Counsel shall report to the two Leaders; the report will include findings of fact regarding all matters relevant to the investigation including any information regarding what laws or rules of the Senate or of Senate committees may apply.
6. The Leaders or their designees will make:
A. The determination on referral to the appropriate law enforcement authority of any possible violation of Federal law; and
B. The determination on whether any rules of the Senate or of Senate committees may have been violated; and
C. The determination on any subsequent recommendation regarding disciplinary action that should be taken against any Senator, official, employee, or person engaged by contract or otherwise to perform services for the Senate, who was responsible for the unauthorized disclosure; and
:selected: D. The determination on any subsequent recommendation for referral to the appropriate Executive Branch agency for :selected: disciplinary action that should be taken against any official or employee of the Executive Branch responsible for the unauthorized disclosure.
7. The Special Independent Counsel shall submit the report to the Leaders within {underlined: 180 days} of the appointment of the Counsel

2. F.B.I., G.A.O. (and other Federal agencies as appropriate) to be utilized to conduct the investigation;
3. Investigation to cover unauthorized disclosures in connection with the following investigation:
Nomination of Clarence Thomas to be an Associate Justice to the Supreme Court, by the Committee on the Judiciary.

B. The determination on whether any rules of the Senate may have been violated, and any subsequent recommendations regarding Senate action, shall be the responsibility of the Leaders or their designees.
The Report is due back to the Leaders in no later than 60 days.
