TO: SENATOR DOLE

SUBJECT: UPDATE ON DRUGS

Yesterday, the House passed four drug bills, constituting the President's Drug Strategy provisions. As of 12:00 noon, Senate Committee staff is still reviewing two of the bills to determine what, if any, problems might exist.

H.R. 3611 -- Foreign Affairs Committee. Contains Strategy waiver of both police training and assistance to governments which have defaulted on loans, but with new House restrictions. No objection by Administration, but they would like to see a few changes on the restrictions. Senate Committee -- Foreign Relations, (Tom Boney, staff -- still reviewing).

H.R. 3614 -- Education and Labor Committee. Contains Strategy Drug-Free Schools and Campuses, but reduces the percentage of money which is sent to Governors by increasing the amount sent directly to school districts. No objection by Administration, but they would like formula change deleted. Senate Committee -- Labor (Nancy Taylor, staff -- deletion of 2 1/2 pages of additional requirements on Governors necessary to make it acceptable to Senate Republicans.). Also, please see Coats drug testing below.

H.R. 3550 -- Judiciary Committee. Contains Strategy's authority for quarterly transfer of $115 million (total) to the Drug Czar's Special Forfeiture Fund to build prisons and pay for High Intensity Drug Areas. Administration has no objection, but would like to delete House added provision that any amount in excess of $115 million be subject to a supplemental appropriation ($150 million is authorized level). Senate Committee -- Judiciary, (Manus Cooney, staff -- Congressman Hughes language to sunset change in Forfeiture Fund to allow state and local law enforcement to use federal forfeiture with funds given back to law enforcement must be deleted -- The Senate provision provides for permanent change which allows state and local law enforcement to receive money without a sunset. This is the Warner issue.).

H.R. 3630 -- Energy and Commerce. Contains Strategy provisions on treatment accountability. Also reprograms $250 million of the $415 million increase in the ADAMHA Block Grant to three new categorical grant programs. Administration desires treatment accountability language, but opposes reprogramming and new categorical grants. Senate Committee -- Labor (Nancy Taylor, staff. Highly objectionable to both Hatch and Kennedy. Categorical grants must be deleted).

DRUG TESTING

Assuming differences could be worked out in the above bills, two drug testing provisions remain.

Coats -- Allows drug testing in schools if local school district desires. Dropped by House, Coats wishes to continue pushing for inclusion. No previous objection by Senate Democrats.

Danforth -- Transportation employees. Not even considered by a House Committee. Danforth would like to arrange for a vote in the House which could be accomplished by adding it to the Transportation Appropriations conference report.

TODAY, TUESDAY, NOV. 14
THE SENATE WILL RECONVENE AT 2:15 P.M., AND BEGIN 3 HOURS OF DEBATE ON THE PACKWOOD-ROTH SUBSTITUTE AMENDMENT REGARDING CAPITAL GAINS AND I.R.A.S. AT 5:15 P.M, THE SENATE WILL CONDUCT 3 BACK-TO-BACK ROLL CALL VOTES, THE 1ST ON CLOTURE ON THE PACKWOOD-ROTH SUBSTITUTE, THE 2ND ON THE ROTH, "SENSE OF THE SENATE" AMENDMENT TO POLAND, AND THE 3RD ON FINAL PASSAGE OF THE POLISH AID BILL. THE 2ND AND 3RD VOTES BACK-TO-BACK WILL BE 10 MINUTES IN LENGTH. ALSO, AT SOME POINT TODAY, IT IS IN ORDER, UNDER A PREVIOUS CONSENT AGREEMENT FOR ME TO OFFER A DRUG AMENDMENT, TO AN AMENDMENT IN DISAGREEMENT, TO THE TRANSPORTATION APPROPRIATIONS CONFERENCE REPORT. THERE IS NO TIME LIMIT FOR DEBATE ON THE DRUG AMENDMENT, HOWEVER, A VOTE COULD OCCUR IN CONNECTION WITH THAT ACTION. ALSO, IF CLOTURE IS INVOKED ON THE CAPITAL GAINS/IRA ISSUE, THEN THE SENATE WOULD REMAIN ON THE SUBSTITUTE UNTIL DISPOSED OF.

WEDNESDAY, NOV. 15
A JOINT MEETING IS SCHEDULED FOR 11:00 A.M. ON WEDNESDAY TO HEAR AN ADDRESS FROM LECH WALESA. SENATORS ARE ASKED TO BE IN THE SENATE CHAMBER BY 10:40 A.M., TO PROCEED AS A BODY, TO THE HALL OF THE HOUSE OF REPRESENTATIVES, TO HEAR THE ADDRESS. FOLLOWING THE JOINT MEETING, AROUND 12 NOON, THE SENATE COULD BE CONSIDERING THE CAPITAL GAINS ISSUE, IF CLOTURE WAS INVOKED, OR ANY CONFERENCE REPORTS AVAILABLE FOR SENATE ACTION. AGAIN, IF CLOTURE IS NOT INVOKED ON TUESDAY, AT 2:00 P.M. ON WEDNESDAY, THE SENATE WILL BEGIN 1 HOUR FOR DEBATE, TO BE FOLLOWED AT 3:00 P.M BY A 2ND CLOTURE VOTE ON THE CAPITAL GAINS ISSUE. ALSO, UNDER THE CONSENT AGREEMENT, IF CLOTURE IS NOT OBTAINED EITHER TIME, IT WILL NOT BE IN ORDER TO OFFER ANY CAPITAL GAINS OR I.R.A. ISSUE FOR THE REMAINDER OF THE YEAR.
A LATE SESSION COULD OCCUR IN ORDER TO MAKE PROGRESS TOWARDS SINE DIE ADJOURNMENT OF THE 1ST SESSION.
ALSO, THE CONTINUING RESOLUTION EXPIRES AT MIDNIGHT ON WEDNESDAY, THEREFORE, SOME ACTION WILL BE NECESSARY, SINCE THE CONGRESS WILL NOT HAVE COMPLETED ACTION ON ALL APPROPRIATIONS BILLS.
