MOST SIGNIFICANT CONCERNS IN BYRD CONTRA AID PACKAGE
1. Provides no expedited procedures for House action; President's request could "die" in House if House Leadership so desires.
Proposal: "Air-tight" expedited procedures for both Houses on a non-amendable "trigger" resolution for already provided lethal aid/interchangeability authority.
2. Expedited procedures "expire" with sine die adjournment of Congress.
Proposal: Retain procedures for one-time use, no matter when Presidential request is made (i.e., even after adjournment ) .
3. Ineffective mechanism to deliver already appropriated humanitarian aid, both current aid and new aid. In fact, current humanitarian aid is undeliverable inside Nicaragua, because of Sandinista failure to live up to their commitment to permit delivery.
Proposal: Presidential discretion to establish alternate delivery system, upon his certification that Sandinistas' conduct does not permit safe and effective delivery by AID and/or PADF.
4. Too narrow definition of humanitarian aid.
Proposal: Definition should include communications equipment, civic action, non-military training and human rights program.
5. Inadequate money for transportation of lethal aid.
Proposal: "As needed" language, but tightly drafted so that money could be used only for transportation.
6. Lethal aid to be delivered by State. (Note: "Summary" of Byrd proposal says "Secretary of State or his designee," but text of proposal does not provide for "designee. ") .
Proposal: Permit President to designate delivery agent.
7. For "interchangeability" guidelines, "comparable purpose, type and value" phrase too narrowly drawn. Contras should not be given entirely new weapons systems or military capability, but neither should the "interchangeability" be limited by "type. " For example, swaps of land mines for bullets should be permitted.
Proposal: Keep equal value concept, and limit items available for swap to those comparable to items previously provided by U.S.
