Boyden Gray, outlining the procedures that the Administration intends to follow with respect to the appointment of federal judges. I have also shared the letter with members of the Senate Republican Leadership. I can assure you that we will make every effort to follow the judicial selection procedures that have been proposed. Nevertheless, I must point out that there is considerable disagreement among Senate Republicans over the validity of these procedures. In addition, it is my recollection and the recollection of other members of the Senate Republican Leadership that the procedures do not reflect any "consensus agreement" reached at a White House meeting on January 16, 1990. Both the Attorney General, on behalf of the President, and the Republican Senate leadership are firmly committed to the principle that federal judges should be chosen on the basis of merit and quality. By virtue of the Senators' familiarity with the members of the Bar in their respective States, the Attorney General, in making recommendations to the President for judicial appointments, will invite Republican members to identify prospective candidates for federal district judgeships. Senators are requested to submit from three to five names to the Attorney General for a particular vacancy. This information should be shared at the earliest practicable time with the Attorney General, so that the Department of Justice can conduct an initial screening, which will generally include interviews with some or all of the candidates. As a result, any questions or reservations as to merit or appropriateness of the proposed candidates can be identified sufficiently early to allow meaningful consultation with the appropriate Senator. The Department of Justice will maintain close contact with the Republican Senators, giving great weight to their views regarding which of the qualified candidates the Department should ultimately recommend to the President for nomination for the district court. Republican Senators are encouraged to submit names to fill vacancies for positions on the circuit court. Mr. Ryan is an effective and experienced government administrator. As Solicitor of the Labor Department, he was responsible for all the legal activities of the department and its legislative program. He managed 1,100 people, including 600 lawyers, and was responsible for broad-scale enforcement, regulatory and litigation activities involving a wide array of statutes. Although Tim Ryan's experience is not directly in the banking industry, his service at the Labor Department was distinguished and indicated his ability to master complicated technical subjects. We are all familiar with the unfavorable decision of the district court in the Olympic Federal case. The uncertainty surrounding the outcome of the appeal, to be heard April 11th, forces us to take action promptly. Delay in the context of conditions in the S&L industry would be a major mistake. The thrift industry needs an impartial and objective regulator who is independent of the industry that created the problems -- the very leadership Mr. Ryan can provide.
