(end of page 16) (page 17) BANQUET CONTRACT Our banquet and conference services are subject to all of the rules and regulations of Vista International Hotel and to the following express terms: DEPOSITS A Deposit of one third of the estimated value of the function is required on booking to hold all function space on a definite basis. The remaining two thirds are required, one four (4) weeks before the event and the other two (2) weeks before the event. FOOD AND BEVERAGE Neither the patron nor its guests or invitees will be permitted to bring food and/or beverages of any kind into the Hotel or into its premises without the express written permission of the Hotel. In the event such permission be granted, the Hotel is hereby authorized to charge for the service of said food and/or beverages. FUNCTION ROOMS Rooms are assigned based on the guaranteed guest count, but the hotel reserves the right to change the designated function room, without notification, if the guest count increases or decreases. Where specific function rooms are requested the hotel will make every effort to provide specific function rooms but cannot guarantee to do so. GRATUITY AND SERVICE CHARGE A gratuity and service charge equal to 18% of the total food and beverage bill will be added by the Hotel unless the patron requests that the banquet waiters and waitresses be permitted to request gratuities from among those present at the function. Banquet service for twenty (20) guests or less will incur an additional service charge. GUARANTEED ATTENDANCE A guarantee of the exact number of guests attending each function must be made by the group representative no later than two working days prior to the function date, by 9:30 a.m. This count cannot be reduced and will be the basis for a minimum charge. If a number greater than the guaranteed count is served, charges will be based on that number. The hotel will be prepared to serve three percent (3%) over the guaranteed count. If no guarantee has been received in due time, the hotel will assume the guaranteed count to be the number provided in the most recent banquet agreement. It is the sole responsibility of the group representative to provide the guarantee. LIABILITY The Hotel shall not be liable for any damages to the patron or patron's guests and invitees in the event causes beyond its control interfere with such performance. Causes which may interfere with or prevent its performance shall include, but not be limited to, labor disputes or strikes, government controls or restrictions upon food, beverages or other supplies, travel or transportation. Patron will conduct the event in an orderly manner, in full compliance with all applicable laws, regulations and Hotel rules. The event shall begin promptly as scheduled, and the event shall be vacated no later than the agreed time. Otherwise, Patron shall be liable for any overtime wages and other expenses incurred. Patron assumes full responsibility for the conduct of all persons in attendance or servicing the event and for any damage done to the Hotel or any persons as a result of the event. The Vista will not assume any responsibility for damages or loss of any merchandise or articles left in the Hotel prior to, during or following patron's function. MENU SELECTIONS Your menu selection should be submitted to the catering office at least four weeks in advance in order to guarantee the availability of the items chosen. Room arrangements and all other details pertaining to your functions must be submitted to the banquet department no later than two (2) weeks prior to the function date. PAYMENT AND CANCELLATION Full payment in advance is required. Final adjustment shall be made no later than at the end of the event. In the event credit has been established, terms of payment shall be worked out at the time thereof. Accounts must be settled in full within thirty days of the function date. In the case that a question arises over certain items on the account, all undisputed charges are to be paid within thirty (30) days of the function date. An interest charge of 1-½% per month will be imposed on all delinquent accounts. In the event of cancellation, the patron shall be held liable for all losses sustained by the Hotel, and all deposit monies may be held to cover said losses. The hotel reserves the right to cancel the contract without notice and without liability when the patron breaches the contract, where the hotel rules were not observed, or where functions are of a nature not acceptable to the establishment. PRICES The per-guest charge set forth in the Banquet Agreement will be based upon then-current market conditions. All charges will be subject to increase in order to meet increased food, beverage and/or operational expenses arising from unusual circumstances existing at the time when the Hotel is to perform its obligations under the Banquet Agreement. The Hotel shall be entitled to receive such increased charges, to make reasonable substitutions to the menu or other services being provided, or to make such accommodations as are appropriate. The patron hereby agrees to pay such increased prices and accept any and all substitutions made by the Hotel. In addition, the Hotel's obligation to perform will not be subject to events beyond its reasonable control (such as strikes, governmental controls or acts of God) and the Hotel will not be liable for any damages if such events interfere with the Hotel's performance of its duties.
